In a push to have criminal charges dismissed in the Waffle House “sextortion” case, attorney Brian Steel made an argument sure to strike a chord with members of the legal profession: Sending a demand letter that threatens a lawsuit, or even threatens that embarrassing media attention and possible criminal sanctions may follow, should not be a criminal offense.

“If filing a demand letter, speaking at a mediation and filing a lawsuit is a crime,” Steel told the court, “I don’t know a civil lawyer or the client of a civil lawyer who would ever want to go through with filing a civil lawsuit.”
