Sam Hardy Jr. was sitting at MARTA’s Arts Center Station sipping lemonade and chatting with a co-worker as they waited for the night’s last train when a passing MARTA police officer ordered him to put a lid on his drink.

Hardy obeyed. But minutes later, after Hardy again removed the lid to take another sip, Officer Alric Gillett returned, and the encounter escalated into a heated verbal exchange as Gillett issued new orders, blocked Hardy as he rose to catch his train, then struck him in the face, according to Hardy’s lawyers.
