New legislation intended to make the Judicial Qualifications Commission more transparent would require that one class of the judicial watchdog’s investigations remain under permanent seal. Those investigations involve judges who may be incapacitated in some way and unable to perform their duties.

The legislation (H.B.126) which has passed the state House of Representatives and is now under consideration in the state Senate, does permit the JQC in some circumstance to file a public report notifying the Supreme Court of Georgia of the disposition of an investigation over judicial incapacity.
