Grier v. State

The Court affirmed defendant's convictions on four counts of aggravated child molestation and statutory rape arising after he initiated a sexual relationship with a 14-year-old student at a middle school where he taught.

Following the denial of his motion for new trial, Rafer Grier appeals his convictions on four counts of aggravated child molestation and statutory rape. On appeal, Grier raises several errors related to his access to the victim’s records with the Department of Family and Children Services DFACS, arguing that he was entitled to the records pursuant to OCGA § 17-16-1, and that the trial court erred in finding that there was no exculpatory evidence in them. He also contends that his trial counsel was ineffective, that the trial court erred in admitting other acts evidence, and that his rights under the Equal Protection clause were violated. Following our review, we affirm.

Viewed in the light most favorable to the verdict, Davis v. State, 275 Ga. App. 714, 715 1 621 SE2d 818 2005, the evidence demonstrates that Grier was a Spanish teacher at Stephenson Middle School when he initiated a sexual relationship with the fourteen-year-old victim, who was in foster care under DFACS custody. The sexual encounters included sodomy and intercourse and occurred multiple times in Grier’s classroom, and, on at least one occasion, outside of school, from January 2008 until the victim reported the sexual relationship in April 2008.
