A CNN investigation of pediatric deaths at a Florida hospital branded its sole pediatric cardiac surgeon as treating the babies on which he operated as “sacrificial lambs” and accused him of making a “total mess” with newborns.
In defending that investigation, CNN attorneys contended those statements were “rhetorical hyperbole” but not defamatory. And they defended the statistical analysis CNN reporters relied on to make their case as a form of opinion that could not support a defamation claim.
