The Georgia Supreme Court reversed the Court of Appeals Tuesday and resurrected a defense verdict in favor of a doctor in a medical malpractice trial that turned on a surprise witness.

Justice Carol Hunstein wrote the unanimous opinion delivering a victory to Dr. Tapan Daftari and his orthopedic surgery practice, Resurgens Orthopaedics. The justices upheld Fulton County State Court Judge Jane Morrison’s decision to exclude testimony during the 2015 trial from a witness who had not been named in advance.
