Benitez v. State

Evidence that the defendant accompanied an individual to a hotel room and sat nearby for up to ten minutes while the individual showed a confidential informant 453 grams of methamphetamine and spoke in English, which the defendant did not understand, was not sufficient to support the defendant's conviction for methamphetamine trafficking.

On appeal from his conviction for trafficking in methamphetamine, Juan Benitez argues that the evidence was insufficient. We agree and reverse. “On appeal from a criminal conviction, we view the evidence in the light most favorable to the verdict, with the defendant no longer enjoying a presumption of innocence.” Reese v. State , 270 Ga. App. 522, 523 607 SE2d 165 2004. We neither weigh the evidence nor judge the credibility of witnesses, but determine only whether, after viewing the evidence in the light most favorable to the prosecution, a “rational trier of fact could have found the essential elements of the crime beyond a reasonable doubt.” Jackson v. Virginia , 443 U. S. 307, 319 III B 99 SC 2781, 61 LE2d 560 1979.

So viewed, the record shows that a confidential informant working with Bartow County police contacted Jose Garduno, who agreed to deliver two pounds of methamphetamine to a room at the Ramada Inn in Cartersville. Officer Mark Mayton left the informant in the room and set up surveillance in an adjoining room; other officers, none of whom appeared at trial, apparently surveilled the exterior. The confidential informant predicted that Garduno and two other people, not including Benitez, would make the buy.
