Hudson v. State

The arresting officer had reasonable suspicion to stop defendant based on his receipt of a radio dispatch indicating that defendant had just left a driver's license post where he was refused service because he smelled of alcohol.

Following a bench trial in the State Court of Cherokee County, William Leroy Hudson was found guilty of DUI-excessive blood alcohol content “BAC”. He appeals and, in his sole enumeration of error, contends the trial court erred in denying his motion to suppress the results of his breath test because the State Trooper did not have a reasonable articulable suspicion to perform a Terry1 investigative stop of Hudson’s vehicle. Since the facts of record demonstrate reasonable suspicion to support the Trooper’s stop of Hudson’s vehicle, we affirm the judgment below.

When we review a trial court’s decision on a motion to suppress, the evidence is construed most favorably to uphold the findings and judgment of the trial court; the trial court’s findings on disputed facts and credibility are adopted unless they are clearly erroneous and will not be disturbed if there is any evidence to support them. The inquiry is whether the officer had reasonable grounds, based on specific and articulable facts, for making the stop. A founded suspicion is all that is necessary, some basis from which the court can determine that the detention was not arbitrary or harassing.2
