Enviromediation Servs. LLC v. Boatwright

There was evidence that a demolition subcontractor exercised sufficient control over the manner, method and means of execution of the work of another company's employee to create a jury issue regarding whether that employee was the subcontractor's agent when he was involved in an accident.

After a jury trial which resulted in a one million dollar verdict against it, Enviromediation appeals. For the following reasons, we affirm.

This case arose on June 22, 1998 when Alonzo Harris drove a dump truck across the center line of Highway 140 in Cherokee County and collided with several vehicles. The collision caused the deaths of John Gordon Boatwright, Misty Dawn Boatwright, and Terri Ann Lamanac. Several other people were injured in the accident, including John Gordon Boatwright, Jr. and James Roy Gordon Boatwright. Following the accident, Harris fled the scene and was apprehended a short distance down the road.
