Dorsey Trailers Inc. v. Knight

In this product liability action involving the malfunction of an aerial lift commonly referred to as a “cherry picker,” Dorsey Trailers, Inc., Mobile Tool International, Inc., and Allen Gibson defendants appeal the partial denial of their motion for summary judgment, contending that the trial court erred by finding that the ten-year Georgia statute of repose should be applied in this case rather than the six-year North Carolina statute of repose. On cross-appeal, Robert Knight and Jean Knight plaintiffs appeal the grant of partial summary judgment to the defendants, contending that the trial court improperly determined the date upon which the Georgia statute of repose began to run, thereby eliminating all of their claims other than a failure to warn claim. For the reasons set forth below, we affirm the trial court’s rulings.

The standards applicable to motions for summary judgment are announced in Lau’s Corp. v. Haskins.1 When ruling on a motion for summary judgment, the opposing party should be given the benefit of all reasonable doubt, and the court should construe the evidence and all inferences and conclusions therefrom most favorably toward the party opposing the motion. Moore v. Goldome Credit Corp.2 Further, this court conducts a de novo review of the law and the evidence. Desai v. Silver Dollar City.3
