The Delaware Republican Party is backing a lawsuit challenging the state’s early and absentee voting statutes, marking the latest challenge to the amount of power a state legislature has in adapting voting laws.

M. Jane Brady of Brady Legal Group, who is also the Delaware GOP’s chair, has filed a complaint against the Delaware Department of Elections and Election Commissioner Anthony Albence in the Court of Chancery on behalf of Michael Mannella, a Newark inspector of elections who claims statutes allowing voting up to 10 days before a general election and permanent absentee registration don’t comply with the Delaware Constitution.
