The ACLU of Delaware and Wilmington attorney Andres Gutierrez de Cos have filed a federal lawsuit against Attorney General Kathy Jennings and the city of Wilmington, claiming the enforcement of loitering laws infringes on multiple civil rights.

The primary plaintiff in the case, filed Friday, is Food Not Bombs, an organization focused on raising awareness about homelessness and poverty which since 2018 has regularly planned meals for about 50 people at a train overpass in Wilmington known to be used for shelter.
