The University of Miami School of Law was set to host the 51st annual Heckerling Institute on Estate Planning this week in Orlando. Morris, Nichols, Arsht & Tunnell partner Todd Flubacher served as faculty and was set to present in the session, “Do Not Feed After Midnight: Structuring and Drafting Trusts and Administration to Minimize Fiduciary Risk” on Wednesday.
Flubacher and fellow panelists Lauren J. Wolven of Levenfeld Pearlstein and Stacy E. Singer evaluated options for reducing trustee liability from the inception of a trust, addressing the selection of the governing law, choice of trustee, and division of duties among fiduciaries. They also discussed issues surrounding due diligence, both at the trust acceptance phase and during ongoing administration.
