An appeal of a bankruptcy case that was denied because it was incorrectly docketed a day late has been revived by the U.S. Court of Appeals for the Third Circuit.
In In re Syntax-Brillian, a Third Circuit panel consisting of Judges D. Michael Fisher, Cheryl Ann Krause and Franklin S. Van Antwerpen vacated a district court order denying plaintiff Ahmed Amr's appeal in his case involving Syntax-Brillian Corp.
Amr was a Syntax-Brillian shareholder and opposed the sale of the company's assets in its bankruptcy litigation, alleging that the company's management and business partners had engaged in misconduct. Amr made a series of motions that were ultimately denied by the court, prompting his appeal.
