The Delaware Supreme Court has found a man's acquittal on drug-dealing charges did not preclude his conspiracy conviction, affirming a lower court's ruling that the man agreed to aid in the commission of a felony.
On Jan. 28, a jury acquitted Xavier Broomer of aggravated possession and drug-dealing charges but found him guilty of conspiracy in the second degree, a Class G felony punishable by up to two years in prison.
The Superior Court denied Broomer's motion for judgment of acquittal in a March 9 bench ruling, saying there was “more than sufficient evidence” for a jury to conclude Broomer had an agreement with his cousin to sell heroin.
