The Delaware House of Representatives voted 24-16 Tuesday to advance legislation to reinstate the death penalty after the state Supreme Court struck down the current capital punishment law as unconstitutional.

HB 125, dubbed the Extreme Crimes Protection Act, aims to remedy the statute by requiring that a unanimous jury find, beyond a reasonable doubt, that the aggravating circumstances of a crime weigh in favor of death.

In a 40-minute-long debate, opponents of the bill reiterated their position that the death penalty has little effect on deterring crime and is too costly to carry out. They also argued that the death penalty itself is fundamentally flawed because of inherent racial biases in its application and the potential for wrongful execution.
