Walgreen Co. and Theranos Inc. on Friday asked a federal judge in Delaware to dismiss a $140 million lawsuit claiming that the Palo Alto-based startup had breached the companies' contract and mislead the drugstore chain about its ability to deliver on its fundamental promise.

Theranos announced earlier in the week that it had reached a confidential settlement agreement with Walgreens and its parent Walgreens Boots Alliance Inc. to dismiss all the claims, with “no finding or implication of liability.”

In a short filing, the companies told U.S. District Judge Richard G. Andrews of the District of Delaware that they had agreed to dismiss the suit without prejudice, but also indicated that additional details still needed to be worked out.
