Insurance companies aren’t off the hook from covering Rite Aid’s defense costs in opioid-related litigation, a Delaware Superior Court judge found Tuesday.

Judge Eric M. Davis issued an opinion granting partial summary judgment in favor of the pharmacy chain and rejected a motion filed by Ace American Insurance Co., Illinois Union Insurance Co., Ace Property & Casualty Insurance Co. and Federal Insurance Co., ruling cases pending against Rite Aid fit within the boundaries of its insurance policy’s coverage.
