A WeWork board committee’s claims can proceed to trial over the opposition of a second, newly established committee, a Delaware Court of Chancery opinion ruled Monday.

In an issue of first impression, Chancellor Andre Bouchard sided with one committee on what standard of review should be used, but the application of that standard worked out in the other committee’s favor as the case is still on track to go to trial in early 2021.
