Lawyers at White & Case and Connolly Gallagher LLP on Monday removed a breach-of-contract lawsuit against Pfizer subsidiary Hospira Worldwide to Delaware District Court. The suit, filed by Ballard Spahr; Carlton Fields and Patterson Belknap Webb & Tyler on behalf of Johnson & Johnson subsidiaries Cilag GmbH International and Janssen Biotech Inc., accuses Hospira of failing to manufacture and deliver ‘ReoPro’ brand blood thinner medication in accordance with an executed development and supply agreement. The suit also pursues claims for lost profits as plaintiffs were unable to meet demand for the drug as a result of Hospira failing to maintain its McPherson, Kansas manufacturing facility in compliance with FDA regulations. The case is 1:22-cv-00589, Cilag GmbH International et al v. Hospira Worldwide, LLC et al.
