A Delaware court’s decision Monday fell in line with others across the country in finding movie theaters can still be on the hook to pay back rent despite closing during the COVID-19 pandemic.

Superior Court Judge Mary M. Johnston granted Simon Property Group summary judgment on four counts, finding force majeure clauses in leases with four Regal Entertainment Group theaters unambiguously assigned the risk of unforeseeable events to the tenants.
