Three embattled Kramer Levin Naftalis & Frankel attorneys have gained a measure of vindication—though maybe not a full-throated one—from Delaware U.S. District Judge Richard Andrews.

The judge on Friday turned away Take-Two Interactive Software’s request for $9 million in “exceptional case” attorneys fees against Kramer Levin and client Acceleration Bay following Take-Two’s summary judgment win in a patent infringement case last year. Acceleration Bay had accused Take-Two’s Grand Theft Auto Online and NBA 2K15 and 2K16 of infringing its patents on gaming technology.
