The Heritage Foundation, a conservative think tank, and Mike Howell, an investigative columnist for the Daily Signal, filed a Freedom of Information Act lawsuit against the U.S. Department of Justice on Aug. 30 in Delaware District Court. The suit, brought by the Law Offices of Murray Phillips & Gay and Samuel Everett Dewey LLC, seeks to compel the U.S. Attorney’s Office for the District of Delaware to produce documents concerning its policy regarding pretrial diversion agreements. According to the suit, the defendants sought expedited processing of the documents as a, ‘matter of widespread and exceptional media interest,’ due to the nature of the Delaware district courts delayed acceptance of Robert Hunter Biden’s associated plea agreement for misdemeanor tax and felony firearms charges. The case is 1:23-cv-00955, The Heritage Foundation v. U.S. Department of Justice.
