The Delaware Court of Chancery has granted a defendant’s motion to stay a derivative lawsuit filed against him because he initiated litigation in Texas involving the same facts and parties prior to the plaintiff’s decision to pursue legal action against him in Delaware.

Vice Chancellor John W. Noble issued the 24-page opinion November 20 inBrookstone Partners Acquisition XVI LLC v. Tanus .
