Unclaimed rebate checks and credits to offset outstanding invoices issued to customers by retailers who operate in Delaware can default to the government after five years under the state’s escheat statute, according to a recent Delaware Chancery Court decision.
Chancellor Leo E. Strine Jr. issued a decision Feb. 2 dismissing the plaintiff’s claim inStaples v. Cook . The chancellor issued his ruling in response to a counterclaim filed by Staples, a Framingham, Mass., office supply retailer incorporated in Delaware, and Thomas J. Cook, the secretary of the state Department of Finance.
