The Delaware Court of Chancery declined to award attorney fees to the prevailing party in a limited liability company dispute, ruling that the losing party was not obligated to pay legal costs under the LLC’s operating agreement.
Vice Chancellor John W. Noble denied the attorney fees request by Krohn Racing LLC, which was seeking to be reimbursed for expenses incurred during a long-running legal feud with Lola Cars International Limited. The dispute,Lola Cars International Ltd. v. Krohn Racing Ltd ., has meandered through the Chancery Court since 2009.
