In an unusual move for an equity court, the Delaware Court of Chancery has ordered a defendant to be incarcerated unless he can prove that he did not violate a 2006 injunction that prevented him from working with any products related to polymers he developed while he was employed as a scientist with W.L. Gore & Associates Inc. It is said to be the first time the Chancery Court has ordered an incarceration in more than 100 years, according to sources familiar with the case.
