The Delaware Supreme Court passed on an opportunity to expand case law governing the application of exclusive forum provisions when it denied a packaging manufacturer’s appeal that could have presented a question of first impression.

Although the appellant sought to overturn a Chancery Court decision upholding the forum bylaw because the court should not have considered statements made by the defendant in another jurisdiction, the Supreme Court denied the appeal because the issue had not been raised at trial.
