The Delaware Supreme Court has dismissed RBC Capital Markets’ initial appeal of three Delaware Court of Chancery decisions in the lawsuit filed against the financial adviser by shareholders of Rural/Metro Corp.

In a three-page order, the Supreme Court said the appeal was not ripe because under Delaware law a decision is not final or appealable until the trial court decides an outstanding application for attorney fees. RBC Capital Markets LLC told the Supreme Court it filed the appeal “out of an abundance of caution” and agreed it should be dismissed without prejudice.
