The ex-CEO of American Apparel isn’t entitled to be advanced his legal expenses in litigation over whether he breached his promise not to disparage the company and to run a proxy contest for the company’s board of directors, Delaware Court of Chancery Chancellor Andre G. Bouchard has ruled.
Dov Charney, the founder of American Apparel, was suspended as the company’s chief executive officer in June 2014, resigned as a director of the company in July 2014 and was terminated for cause as CEO in December 2014 amid a bevy of sexual harassment lawsuits and other litigation.
