Chancellor Andre G. Bouchard, in issuing a sanction against a law firm of more than $135,000 over behavior thwarting the fair conduct of a deposition, has checked what he characterized as overly “aggressive” litigation tactics.
In Shawe v. Elting, the law firm for the co-founder of a global leader in supporting litigation and translation services has been sanctioned $135,323 because, Bouchard found, one of the attorneys at Kramer Levin Naftalis & Frankel jeopardized the finding of a deposition in the hotly contested case.
