The Delaware Court of Chancery earlier this month held Indiana-based Berry Plastics Corp. liable for pension responsibilities stemming from its $135 million purchase of a health care containers business in 2014, as the court parsed the meaning of the word “threatened.”

In the case, captioned Rexam v. Berry Plastics, the court found the term required a clear intent to bring an action before a third party.
