As the economy continued to struggle in 2010, employers faced additional challenges following changes within the federal agencies, the appointment of a new Supreme Court Justice, and the implementation of new laws and regulations. Patient Protection and Affordable Care Act (“PPACA”)

In March 2010, the United States saw some of the most sweeping changes in health care through the PPACA and as amended by the Health Care and Education Reconciliation Act. Three provisions became effective in 2010: (i) amending the FLSA to add whistleblower protections; (ii) issuing regulations regarding “grandfathered” health plans; and (iii) extending dependent coverage to a participant's adult children until the child reaches age 26.
