A federal judge yesterday said Toyota Motor Co. may appeal a 9th Circuit decision that would have allowed Toyota owners who were not affected by unintended acceleration problems to join a class action suit. Those individuals are seeking economic damages.

If Toyota appeals, which it is expected to do, the 9th Circuit will have to decide if it will hear the case. Plaintiffs attorney Marc Seltzer said if the circuit court does agree to hear the case, he's confident it will affirm the decision.

This is just one of many lawsuits Toyota is dealing with since it had to recall more than 8 million vehicles due to sudden acceleration issues.
