Former F&C Asset Management legal head Gillian Switalski is to have her multimillion-pound sexual discrimination and constructive dismissal claim against her former employer re-examined by the Employment Tribunal.

The fresh ruling comes after F&C's claim for the case to be reheard – made during a constructive dismissal hearing in June – was denied. However, the new ruling has granted the company's appeal for the case to be reconsidered.

The Tribunal had previously ruled that sexual discrimination, harassment and victimisation in the workplace had meant that Switalksi (pictured) was no longer fit to fulfil her role. F&C failed in their bid to have the ruling overturned in May, with Switalski claiming £19m in compensation.

Commenting on the latest decision, an F&C spokesperson said: "We are obviously pleased that the Employment Appeal Tribunal have decided that the findings made some time ago that Ms Switalski had been subject to discrimination and had also been constructively dismissed must be looked at again by a fresh Tribunal. F&C is a company committed to equal opportunities with a strong anti-discrimination culture."

During the June hearing, F&C accused the lawyer of faking illness in order to secure a large payout.

The company claimed that Switalski – while claiming she had been unfit for work – had accepted a new role with insurance and investment company Royal London.
