The Department of Health and the NHS Litigation Authority (NHSLA) have appointed a new panel to provide legal advice to 16 health organisations.

In total, 14 firms have won places on the panel which will advise the NHSLA alongside 15 other Department of Health organisations.

The roster, which replaces a previous line-up advising the NHSLA alone, is sub-divided into three: clinical liability; non-clinical liability; and regulatory, health and disciplinary, with all 16 health organisations able to use all three sub-panels.

Eleven firms will advise on the clinical negligence roster, while six firms have taken places on the non-clinical panel. Meanwhile, 11 firms have taken places on the newly created regulatory, health and disciplinary panel.

Five firms – DAC Beachcroft, Hill Dickinson, Kennedys, Weightmans and Browne Jacobson – have taken places across all three areas.

Organisations that will use the new panel include the Care Quality Commission, the Human Fertilisation and Embryology Authority, and the Medicines and Healthcare Products Regulatory Agency, as well as the Department of Health itself.

Eversheds, which previously held a role on the NHSLA's clinical negligence panel, has not won a place after pulling out of clinical negligence work in 2008, striking a deal with DAC Beachcroft which saw the 11 lawyers from Eversheds Leeds and Newcastle offices move over.

The panel appointments are for four years, during which hourly rates will be fixed and the firms will provide additional services to support the NHS. Previously organisations procured their own legal advice, while this new approach is expected to deliver significant savings.

The new panel went live on 28 May 2013.

The new panel is separate to the Government Procurement Service's roster of external advisers which was finalised in January this year. The 48-strong panel includes magic circle firms Allen & Overy, Freshfields Bruckhaus Deringer and Slaughter and May.

The overhaul of the panel – formerly known as Catalist – was originally launched in September 2010 in a bid to reduce Whitehall's legal spend and cut back the number of firms used by Government departments. The roster is intended to cover central government contracts valued at more than £100,000. The value of the framework is estimated at up to £250m over a period of up to four years.
