Former GFH Capital general counsel David Haigh has had an application for a private prosecution against ex-Gibson Dunn partner Peter Gray and two GFH executives dismissed.

Sitting in Hammersmith Magistrates' Court on Friday, district judge Tan Ikram dismissed the case after Haigh (pictured) decided not to pursue his application.

In his judgment Ikram said that "matters have been reported to law enforcement authorities" and that Haigh and his counsel had been in discussions with them and had subsequently dropped the attempt at a private prosecution.

Haigh's application originally alleged that Gray and two GFH executives were guilty of fraud and conspiracy relating to an ongoing case between Haigh and his former employer, GFH in Dubai.

Haigh was represented by Alun Jones QC from Great James Street chambers.

Bryan Cave partner Robert Dougans, who acted for GFH, called the application for a private prosecution "an inappropriate collateral attack on civil and criminal proceedings in the United Arab Emirates (UAE)" and "a crude attempt to divert media and public attention away from these proceedings".

"We believe that the best approach now should be to wait until the UAE courts decide the matter," Dougans added.

Gray, who was not present at the hearing, was represented by Adrian Darbishire QC of QEB Hollis Whiteman. Patel and Al Rayes, who were also not present, were advised by Matrix Chambers' Andrew Bodnar.
