Clyde & Co took home the Dispute Resolution Team of the Year award for its work on an international arbitration case and subsequent appeal, which set a precedent that has been followed by numerous others in Dubai International Financial Centre (DIFC) award enforcement cases.

The team was praised by the judges for its "truly innovative and groundbreaking approach" and was credited with inspiring its client to "seek an outcome for which there is no prior precedent".

The Clyde & Co team was led by Dubai disputes partner Keith Hutchinson and also included Dubai-based consultant Alec Emmerson and Singapore-based consultant Brian Nash.

The team was acting for Banyan Tree Corporate, a Singapore-based hotel management company, in a dispute with Meydan Group, the owner of a Dubai hotel.

The dispute centred on the wrongful termination of a hotel management agreement by Meydan.

The firm acted for Banyan Tree in the initial Dubai International Arbitration Centre dispute, which ended with Banyan Tree receiving a $20m award.

The award was subsequently enforced in the DIFC courts after a challenge to the courts' jurisdiction in this case.

The jurisdiction of the DIFC courts to enforce arbitration awards regardless of their origin and regardless of either of the parties having a connection to the DIFC was upheld on appeal.

This has set an enforcement precedent that has been followed by subsequent enforcement cases in the DIFC courts.
