The long-awaited new restructuring law that will enter into force on January 1, 2021. The implementation of the Act on Court Confirmation of Extrajudicial Restructuring Plans (CERP or, in Dutch, WHOA) will result in the Netherlands having a flexible, state of the art preventive restructuring regime with the potential to transform the Netherlands into a restructuring hub for international groups that face financial difficulties and look for possibilities to continue their business. In this article, we briefly set out key features of CERP.
