The Supreme Court of Kenya has ruled that its decisions cannot be reviewed by the East African Court of Justice (EACJ) even though Kenya and seven other countries helped establish the court—a precedent-setting decision that poses a significant threat to the future of the cash-strapped regional court.

The Chief Justice Martha Koome-led bench declared that domestic courts and regional courts do not have a vertical relationship on May 31. As such, the decisions of the court are not subject to appeal at the EACJ, sitting in Arusha, Tanzania.
