You might think that if you are an organization based outside of the EU then the answer to this question is “nothing at all,”, but that is not the case. In fact, the extra-territorial reach of the AIA is another example of why global companies seeking to sell into the EU need to understand the implications.

While the OECD continues to count the sheer number of recommendations, guidance documents, policies and draft pieces of new law around the world (800 and counting), the fact is that the AIA is likely (again) to have global impact. The so-called Brussels effect strikes again, whereby many organizations will conclude that compliance with the AIA constitutes the gold standard, allowing them to defend themselves against complaints, and to prove compliance with best practice.
