Attorneys in a class action against Volkswagen over allegedly leaky interiors are heading back to the negotiating table now that a settlement estimated at $69 million has been upended.

The U.S. Court of Appeals for the Third Circuit held on May 31 that approving a class that was split into two groups, with one getting priority access to an $8 million fund, created an intraclass conflict that could not stand.
