Why Artificial Intelligence Can't Compete With Humans, and Vice Versa
Limited by its computational nature, AI in legal falls short of being able to interpret and contextualize data the way attorneys can.

Lawyers today can be forgiven for thinking artificial intelligence (AI) is taking over their industry. From AI contract review squeezing the demand for outside counsel to governments calling for laws to regulate and limit how AI is deployed, there is much to fuel this apprehension. Not to mention that oftentimes, it seems that the capabilities of AI are limitless. While AI solutions such as ROSS market themselves as an ” artificially intelligent attorney,” others are popping up that are capable of predicting the outcome of trial cases with up to an 80 percent accuracy.
But what is commonly missing from the conversation over AI is the context of how it compares and contrasts to human intelligence. While overlapping in some regards, the two intelligences hold vastly different and unique strengths which, for the time being, cannot be matched by one another.
AI in legal most commonly encompasses machine learning, the ability for software to “learn” and understand a task or a data set, far better and more efficiently than any human practitioner can. It is why AI is being relied on more than attorneys to manually review contracts, or scour through databases to make connections in data.

The action, filed Oct. 7 in New York Southern District Court by the Brown Law Firm, accuses the company's directors and/or officers of falsely expressing confidence in the company’s restructuring of its sales incentive plan and downplaying the severity of decreases in its upfront commitments. The case is 1:24-cv-07594, Roy v. Ittycheria et al.

The suit was filed Sept. 7 in Wisconsin Western District Court by Levine Eisberner LLC and Siri & Glimstad on behalf of a project manager who claims that he was wrongfully terminated after applying for a religious exemption to the defendant's COVID-19 vaccine mandate. The complaint was filed Sept. 4 in Connecticut District Court by attorney Robert M. Berke on behalf of former employee George Edward Steins, who was arrested and charged with employing an unregistered home improvement salesperson. The complaint alleges that had Sunrun informed the Connecticut Department of Consumer Protection that the plaintiff's employment had ended in 2017 and that he no longer held Sunrun's home improvement contractor license, he would not have been hit with charges, which were dismissed in May 2024.
