When Max Schrems won his 2015 lawsuit invalidating the EU-U.S. Safe Harbor and later had the Privacy Shield tossed in 2020, companies were shocked and confused. 

The high-stakes decisions from the Court of Justice of the European Union not only impacted day-to-day data transfers, but also added to the laundry list of risks considered by law departments before implementing cloud-based software such as of Microsoft Office 365. A panel gathered for Legalweek(year)’s “Leveraging Microsoft 365 in a Post-Schrems II World” session looked at the ongoing risks of leveraging the cloud and how legal professionals can navigate them.
