While businesses wait for the months-long approval process for the new EU-US data transfer agreement, attorneys say they shouldn't let their Privacy Shield certifications lapse.

Nearly six months after word came down that the U.S. and the European Commission had reached an agreement on a new EU-U.S. Data Privacy Framework (EU-US DPF), President Joe Biden signed an executive order to implement the new pact last Friday.
The DPF would replace the former data partnership outlined in the Privacy Shield, which was the successor to Safe Harbor agreement. Both the Privacy Shield and Safe Harbor pacts were struck down in 2020 and 2015, respectively, after concerns were raised about data collection activities by U.S. intelligence agencies.
