While states are likely to continue to pass Virginia-like data privacy laws, others may be inspired to follow a more recent, sector-specific approach from states like Arkansas or Washington.

Recent state data privacy laws had started to align with Virginia's approach—which itself took its cues from a failed Washington state law—offering a temporary relief to companies collecting user data across the country. But that relief may have been short lived as the Hydra of data privacy regulation adds a couple of more heads.

The action, filed Oct. 7 in New York Southern District Court by the Brown Law Firm, accuses the company's directors and/or officers of falsely expressing confidence in the company’s restructuring of its sales incentive plan and downplaying the severity of decreases in its upfront commitments.
