LexisNexis Applied Discovery has been front-and-center in a controversy about its EDD practices. Ben Hallman, of The American Lawyer, broke the story on August 9, which we reprint on page 36. LNAD responded with a letter, which appears on page 49, and the conversation’s been continuing on my blog, The Common Scold, at www.thecommonscold.

Then, on August 11, Robert Elder, of Austin’s American-Statesman, reported on another EDD battle, this time between Renew Data Corp. and its lawyers, DLA Piper Rudnick Gray Cary. The EDD vendor claims the firm improperly disclosed confidential material during a patent application — but that’s only the half of it. When competitor Kroll Ontrack Inc. got wind of the Renew Data application, they sued — and settled for “a substantial, confidential amount” — over claims that defecting employees violated their non-competes and shared Kroll’s trade secrets, reports Elder.
