A potential class action filed late last week in the Northern District of California takes on data loss in mobile devices, alleging that Palm and Sprint Nextel have failed to adequately back up customers’ data.

After replacing his Palm Pre phone when the power button on the old one broke, plaintiff Jason Standiford of San Francisco realized that almost all of his data had failed to transfer to the new phone, the complaint alleges. Of his hundreds of contacts, for example, he now had only four — two of which were for Sprint customer service. The complaint contends that data losses such as this one point to a weakness in webOS, Palm’s operating system.
