The term “thumbdrive” can now be trademarked, thanks to White & Case’s victory for Trek 2000 International, inventor of the ThumbDrive USB flash drive.
The Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office had initially held that the word was generic. But in a Nov. 30 ruling, the appeal board held that Trek’s ThumbDrive trademark is not generic and is entitled to be registered with the USPTO.
