A police officer’s belief that child molestation suspects typically have child pornography in their homes is not probable cause for a search warrant, the 9th U.S. Circuit Court of Appeals decided Tuesday.
While investigating reports that a sixth-grade teacher, Bruce Dougherty, had touched students inappropriately, the City of Covina, Calif., police obtained a search warrant for the suspect’s and his son’s home computer equipment.
